			<content:encoded><![CDATA[<p><img class="alignleft" title="Titanic" src="http://upload.wikimedia.org/wikipedia/commons/6/6e/St%C3%B6wer_Titanic.jpg" alt="" width="500" height="374" />&#8220;In the Matter of Rose DeWitt&#8221; examines Ms. Rose DeWitt&#8217;s contention that she denied due process when the New York State Board of Law Examiners nullified her July 2009 exam based on allegations that she cheated.</p>
<p>The Examiners&#8217; allegations stemmed from Ms. Dewitt&#8217;s repeated craning of her neck to study the answers of her neighbor.   The exam proctors saw Ms. Dewitt repeatedly look at her neighbor&#8217;s papers during two day of the exam.</p>
<p>Afterwards, the Examiners conducted a hearing which resulted in the nullification of Ms. DeWitt exam.  She then filed for review of the administrative decision in state court (in Albany).     The state court transferred the case to the Appellate Division, Third Department.</p>
<p>The Appellate court <em>declined</em> to toss a life preserver ring to Ms. DeWitt.  Instead, the court said that the Examiners  provided &#8220;expert proof of strong statistical evidence&#8221; that Ms. DeWitt copied answers from her neighbor exam taker.  The court upheld the Examiners administrative decision.</p>
<p>This pretty much ends any hope of Ms. DeWitt, who is 45 (and who was a practicing attorney in Russia for 14 years) of ever clearing a moral character query in New York or any other state.</p>
<p>Unlike the fictional Ms. Rose DeWitt Bukater who <em>survived</em> her voyage to New York, this Ms. Rose DeWitt did not.</p>

			<content:encoded><![CDATA[<p>As the proprietor of this Pass The Bar Exam blog, I spend a bit of time twice each year reviewing the mass of sample answers posted by various reputable bar tutors. Of course, the purpose of posting sample answers is to drive bar candidates to purchase the guidance of the tutor/author, and that&#8217;s certainly not a bad thing&#8230;especially if the candidate is not &#8216;getting it&#8217; on her/his own.</p>
<p>Recently, my old friend the <a href="http://californiagbx0707.blogspot.com/" target="_blank">the Grand Poobah</a> posted on his blog about the <a href="http://one-timers.com/additional-resources/most-recent-california-bar-exam-model-answers.html" target="_blank">July 2011 California Bar sample answers</a> created by Jason Tolerico, the brains behind <a title="One Timers Bar Prep" href="http://one-timers.com" target="_blank">One Timers</a>.  I took a look at Mr. Tolerico&#8217;s sample answers and was very impressed by his presentation style for the sample answers.</p>
<p>Mr. Tolerico&#8217;s  approach made it clear that every element of the question would be examined in the answer, which many (including myself) believe is a key to getting the maximum number of answer points.</p>
<p>Drop by Mr. Tolerico&#8217;s site and take a look at his work, and approach to answering questions.</p>
<p>Recommended.</p>

<p>But alas, now for many the dreams have been replaced with the waiting.  For some, the last week before the results are released seems to be the toughest (I don&#8217;t even talk about the last 8 hours, but you know&#8230;).</p>
<p>In any event, hang in there. It&#8217;s just one more week in your life, but that week begins now.</p>
